While eBay doesn't want you to email another user to try and set up a sale off-line, you don't have to.

Just email them and say you missed the end of the auction and hope to see them relist it.

You haven't offered to buy it off-line, which means you haven't violated eBay's use of their email link. But there isn't a seller out there that won't immediately email you back (without using eBay's email links) and offer to directly sell it to you.

So, see? You can keep within eBay's restrictions, but do what you want. Just word it right.

Yep, could be a matter of interpretation. In any case I heard from one person I spammed before getting spooked and he was grateful for the heads up. Unfortunately it came too late, the item is snapped up already. Sold.
