The issue seems to be the capability to respond to unconventional warfare, relying on the opponent to be able to only respond conventionally in environments and situations where such behaviour can only have a restricted number of predictable responses.

Exactly the sort of window of operations that would obtain in the OTU or any number of 'loose government due to comms/travel limits' situations.

I would argue the 'rule of men not of laws' bit means everyone plays hardball this way, including the Imperium.
