Scans...maybe fair use

I need an excellent PDF scan of the front & back covers of the Atlas of the Imperium for a visual prop in a game (hence 8.5x11 PDF). Pretty sure this does violate Fair Use. But, I am prepared to get Marc's go ahead, if it is needed.
 
...and if you get said scans, send them to Marc -- the CT CD-ROM could use a better AoTI cover.
 
Sounds like a fair exchange to me.

Beats me why FFE and SJG haven't invoked 'fan participation' to produce PDFs of popular oldies before - saves a lot of 'we haven't got the manpower'. All they need to do then is proofread it. It's not like back in the seventies when you needed professional lithograpic machines to prepare stuff. These days anyone can produce good quality PDFs in their home and send the stuff out. It can't offend copyright if it's being done on behalf of the copyright holder.

Now I'm wishing I'd said this when I first saw the post.

If you're pretty sure it violates fair use policy (and I'd say it does clearly) and you are prepared to get Marc's go ahead, why not go that route? And avoid posting here encouraging (and succeeding) in getting others to violate the generous fair use policy for you. Others have gotten well deserved warnings for similar requests. What makes this different?
 
IF Marc wants good scans it's up to him to ask for them and provide a legit place to send them. While I agree the CDs could do with fixing, and it looks like that is in the works through DonM fronting for Marc, it's not something anyone can just start up on their own.
 
I think you're reading farther down on that list Marc gave me, but I'm taking the requests one at a time, and he gave first priority to people who paid for the BFB reprints.

But YES, since it does violate fair use, ask Marc.

If I were Roger Sanger, I'd snatch the DGP scans that are floating about on teh web and put them up on rpgnow. They'd sell like hotcakes.

IIRC, that's what WOTC (or even Marc, come to think of it?) did with pirated scans (a cover image?) of some old TSR product or other.
 
Yes, the copy of AotI on the CT CRDOM is a pirate scan by someone calling themselves "Kritter" (according to the stamp on the back cover image in the pdf).

I have a very good copy of AotI, with nice covers. I'd be willing to scan the cover and send or put up (at a URL) the files for Marc to use. But I'd need an email from him giving me the OK to do it first.

But RS can't put them up on DTRPG even if he wanted to... it would violate Marc's Trademarks.

#2) I copied small parts/sections of it for graphic/visual aid distribution for my private inner gaming circle (i.e. my own players only, and no one else). Strictly for gaming use as an aid.

Not fair use. But who's to know you did it anyway? It's fine even without fair use to prepare materials for your game session, as long as they stay in your possession.

Go read the Fair Use everybody (in the FAQs iirc). I think it's pretty straight forward. It's not a license to copy and distribute.

I did indeed read the FAQ for FFE and found this:

4a) Can I make a PDF of Traveller Stuff? Can I make scans of Traveller pages?

Yes. Subject to Fair Use, you can make scans or PDFs of pages from books you own. If you are making scans or PDFs for some project you are doing, there should be no problem. If you are PDFing a whole book, you've gone too far.
It sounds like copying select bits and pieces for your gaming session is just fine if you define "some project" as a gaming session...

I guess you could at that :)

I'd never thought of a "project" being a game session (or vice-versa). Partly because I figured who's to know what goes on at my game table between me and the players, right?

And I'd always taken "project" to mean a publicly posted work or discussion (I think I got that from somewhere in the Fair Use policy, using a paragraph or two, no more than a page, in a discussion being allowed).
